1. WASHIN APPLICATION PUBLISHER 

The WASHiN Application (hereinafter the "Application") is published and operated by WASHIN (hereinafter "WASHiN"), a SAS with capital of 13,470 euros, headquartered at 12, rue Saint Denis, 34.000 MONTPELLIER, France, registered in the MONTPELLIER Trade and Companies Register under number 852 726 165.

1. WASHIN APPLICATION PRESENTATION

WASHiN has initiated the deployment of a network of its own laundromats, installed either in dedicated stores or in collective accommodation (university residences, hotel residences, campsites, etc.).

These laundries are equipped with connected washing machines and dryers that can be controlled remotely, hereinafter referred to as "Machines".

The Application is a Web and mobile application designed for remote management of Machines. In particular, it enables users (hereinafter referred to as "Users") to :

• Locate the nearest Machines ;
• Check availability of Machines ;
• Reserve a washing machine for 10 minutes;
• Choose from various wash and dry programs;
• Pay for Machine services online;
• View the progress of machine wash and/or dry programs and remaining time remotely;
• Receive notification of the end of the wash and/or drying program.

• SCOPE OF THE GENERAL CONDITIONS OF USE

These general conditions of use (hereinafter the "GCU"), drawn up in French and English, govern the conditions of use of the Application by its Users, as well as the conditions of reservation and use of the Machines.

They can be consulted directly on the Application at the time of each order as well as on the WASHiN website, accessible at the address "washin.fr".

The GCU constitute all the contractual terms binding WASHiN to Users.  

All access to and use of the Application, as well as all reservations and use of the Machines, presuppose the prior, complete and unreserved acceptance of these GCU. 

The User is therefore invited to keep a copy.

WASHiN reserves the right to modify these GCU at any time, subject to informing Users of such modifications. In the event of modification, the new GCU will come into force and replace the previous ones as soon as they are communicated to Users by any means whatsoever, in particular by e-mail.

If one or more stipulations of these GCU are held to be invalid or declared as such in application of a law, regulation or following a final decision of a competent court, the other stipulations retain all their force and scope.

1. APPLICATION ACCESS - USER ACCOUNT

In order to use the Application, the User must first download and install it on a mobile terminal (smartphones, tablets running IOS, Android, HarmonyOS).

The Application can be downloaded free of charge from the Google Play Store App Gallery and Apple Store application portals. Acceptance of the terms and conditions of use of these portals is the sole responsibility of the User. WASHiN shall not be held liable for any failure to comply with the rights and obligations contained therein.

Access to the Application and use of the Machines also necessarily implies the creation of a User account, hereinafter the "User Account".

To do this, the User must complete the account creation form integrated into the Application, providing the following information: first name, last name, email address, telephone number and password. Once this information has been entered, the User is invited to read these GTUs and WASHiN's privacy policy. The User confirms that he/she has read and accepts the terms of these documents by activating the "slider" switches, which are deactivated by default, and then clicking on the "Create an account" button.

Only persons with the capacity to contract may use the Application and the services offered by WASHiN. The User therefore declares that he/she has the legal capacity to enter into valid commitments under these GCU and the privacy policy, and acknowledges that he/she has the skills and means necessary to access and use the Application and the Machines.

When creating a User Account, the User undertakes (i) to provide all the information requested in the fields to be completed, (ii) to provide complete, accurate and up-to-date information, and (iii) to modify his or her information in order to keep it complete, accurate and up-to-date until his or her User Account is closed.

The User will then receive an email confirming the creation and activation of his User Account.

The User may use the email address and password provided when creating his User Account to log in to his User Account at a later date.

WASHiN reserves the right to refuse to create a User Account for any person who does not meet the conditions for creating such an account.

The User is solely responsible for the security and confidentiality of his/her login and password. The User undertakes not to transmit or transfer in any way whatsoever his/her User Account or any information relating thereto to any third party.

All use of the User Account is presumed to have been made by the User holding the User Account. The User is hereby informed that he/she is responsible for all access and use of the Application made by him/her or by any other person using his/her User Account, in particular by his/her children or by third parties, whether or not he/she has authorized such access or use.

The User undertakes to inform WASHiN immediately in the event of loss, theft, forgetfulness or suspicion of loss or theft of the User ID or password. The User also undertakes to inform WASHiN of any unauthorized use of the User's Account by a third party.

However, if you have simply forgotten your password or wish to change it, please click on the "Forgot your password?" link and follow the steps indicated to reset your password.

Once a User Account has been created, the User can consult and modify the information relating to his or her User Account in the "History" and "Profile" sections, consult the information available on the Application, and access the services offered in the Application.

1. PROGRAM CONTROL AND MACHINE OPERATION

• Suggested programs

In order to use the Machines, the User can choose from the various washing and drying programs offered in the Application, hereinafter referred to as the "Programs".

The Application provides Users with the information they need to choose and use the Programs. Users are thus informed of the essential characteristics of the Programs (location of the Machine, indicative duration of the Program, type of Program, temperature of the Program for washing machines - it must be chosen directly on the dryer for drying programs - capacity of the Machine, etc.).

Consequently, Users alone are able to determine whether the Programs correspond to their needs, and choose the Programs with full knowledge of the facts.

The Programs and Machines comply with the requirements of French law relating to personal health and safety and consumer protection. In particular, WASHiN checks every week that the safety devices on the Machines made available to Users are working properly.

The detergent (Ecocert® certified) is systematically supplied with each wash program and is automatically injected during the wash.

• Program prices

Program prices are quoted in euros, all taxes included. The applicable rate is that in force on the day the order is placed.

WASHiN reserves the right to modify its prices at any time, while guaranteeing the User the application of the prices in force on the day of the order.

• How to order Programs

To order a Program, the User must follow the procedure below:

• The User must first identify himself through his User Account.

• The User must then select the laundromat located around his or her position. To do this, the User can accept to be geolocated or select the laundromat from the drop-down menu.

• The User can then access the following sections:

• Washing machines: By clicking on the "Washing machines" heading, the User can view the washing machines available, choose the washing machine(s) he/she would like to use and select the Washing Program that suits him/her best. The User is then directed to a "Verification" page which summarizes the Programs selected.

• Tumble dryers: By clicking on the "Tumble dryers" heading, the User can view the tumble dryers available, choose the tumble dryer(s) he/she wishes to use, and select the Drying Program that suits him/her best. The User is then directed to a "Verification" page which summarizes the Programs selected.

• Reserve a machine: By clicking on "Reserve a machine", the User can view the available washing machines and then select the washing machine he or she would like to reserve free of charge for 10 minutes. Reservations are not possible for tumble dryers.

• At any time, the User can obtain a summary of the Programs selected by clicking on "Check", and go back over the different stages of his order by adding, modifying or removing Programs from his order. Once the User has checked his/her order, he/she can validate it by clicking on the "Validate" button.

• A summary is then displayed showing, for each Program selected, the Machine references, the Machine capacity in kilograms, the type of Program selected, the indicative duration of the Program and the cost (including VAT) of the Program, less any discounts granted.

• If the User is satisfied with the summary, he/she can confirm the order and proceed to payment by clicking on "Proceed to payment".

Before clicking on "Proceed to payment", the User must first check the box to accept these GCU and the box to accept WASHiN's privacy policy.

Before clicking on "Proceed to payment", the User also has the option of adding a discount code by activating a "slider" switch, deactivated by default. In this case, the User must complete the appropriate field with the discount code, then click on the "Recalculate" button.

Before clicking on "Proceed to payment", the User can also choose to save his/her credit card details for future payments by activating a "slider" switch, which is deactivated by default.

• After clicking on "Proceed to payment", the User is redirected to a payment page.

Once payment has been made, the User may immediately use the Machine(s) selected in the laundromat chosen. If he does not use it, once he has reserved the Machine, his order will be lost and he will not be able to obtain a cancellation or refund.

• Payment

After clicking on the "Proceed to payment" button, the User can choose between payment by credit card and payment via the Lydia application.

By clicking on the "Credit card" button, the User can choose his or her payment method from among those shown: e-Carte Bleue, CB, Visa Electron, Visa, Mastercard, Maestro, Paylib. The User must enter his bank details in the fields provided: card number, expiry date and visual cryptogram.

The User definitively validates the transaction by clicking on the "Validate" button.

By choosing the "Paylib" payment method, the User can make the payment via his user account on the Paylib application. Where applicable, Paylib's general terms and conditions of use will apply. Acceptance of the general conditions of use of this application is the sole responsibility of the User. WASHiN shall not be held liable for any failure to comply with the rights and obligations set forth therein.

Similarly, by clicking on the "Lydia" button, the User can proceed to payment via his user account on the Lydia application. In this case, Lydia's general terms and conditions of use will apply. Acceptance of the terms and conditions of use of this application is the sole responsibility of the User. WASHiN shall not be held liable for any failure to comply with the rights and obligations contained therein.

Once payment has been validated, a confirmation email detailing the order is automatically sent to the email address entered by the User when creating their User Account. The confirmation email is written in French or English, depending on the language chosen at the time of ordering. It contains, as attachments, a summary of the order, the corresponding invoice and a copy of the GCU applicable at the date of the order.

The User is advised to keep a copy on paper or electronically.

All data recorded and confirmation sent by WASHiN constitute proof of all transactions between WASHiN and the User and constitute proof of the date, nature and content of the order.

In addition, a history of orders made by the User is available in the "History" section of his User Account.

Once the order has been validated and paid for, and insofar as the Machine has been reserved for the User, the order can no longer be cancelled or modified, subject to refusal of the order by WASHiN under the conditions of article 5.5 below. In this respect, the User is reminded that, if he is unsure of his order, he always has the option of reserving a washing machine free of charge for 10 minutes.

• Right of withdrawal

In accordance with the provisions of article L.221-28 1° of the French Consumer Code, in order to immediately use the Machines and benefit from the Programs he/she has ordered, the User expressly waives his/her right of withdrawal.

Indeed, the right of withdrawal does not apply to the supply of services fully performed before the end of the withdrawal period and whose performance has begun after the consumer's express prior agreement and express waiver of his right of withdrawal.

• Program execution and machine operation

The User must launch the Program he has ordered as soon as his order has been confirmed. In order to ensure that information on the availability of Machines is accurate and up-to-date, it is not possible to order a Program for use at a later date.

To launch the Program he has ordered, the User must follow the procedure described below:

In the event that the Program does not launch or the Machine does not function, the User is invited to check his network connection and the regularity of the order process he has carried out, as well as the effectiveness of the payment he has made. The Application reports to WASHiN any Machines likely to be affected by malfunctions, so that these Machines cannot, in principle, be reserved, and are indicated as "out of service" in the Application, and therefore unavailable.

If the Program is still not launched despite this check, the User is invited to contact WASHiN's customer service department at the address specified in article 1 in order to seek a solution and, if the service cannot be effectively provided, to be reimbursed by WASHiN.

The User undertakes to :

• use the Machines in accordance with their intended purpose and the instructions for use and safety given to him/her by WASHiN and/or communicated to him/her either on the coin laundromat site or within the Application, in particular through the following documents: "User instructions", "Tips", "Dryer", "Safety Guide".

• use the Machines in compliance with applicable laws and regulations;
• use the Machines for personal purposes only, to the exclusion of any commercial use.

For safety reasons, it is strictly forbidden for children to use the machines.

1. UNINSTALL APPLICATION AND CLOSE USER ACCOUNT

The User may, at any time, stop using the Application and uninstall it from his/her terminal. Access to the information contained in the Application is provided for the duration chosen by the User, from the opening of his/her User Account until its closure.

The User Account may be closed at any time at the User's initiative, simply by sending an e-mail to "dpo@washin.fr". The User is informed that uninstallation of the Application does not automatically lead to closure of the User Account.

The User will receive an e-mail confirming the closure of his User Account.

The User Account may also be closed at the initiative of WASHiN in the event of (i) failure by the User to comply with the provisions of these GCU, (ii) use of the Application or the Machines for purposes and under conditions that do not comply with those set out in these GCU, (iii) damage to the Application, in particular in the event of infringement of intellectual property rights over the Application or impairment of the operation of the Application, (iv) infringement of the Machines or the operation of the Machines, (v) disparagement by the User of the Application and the services offered by WASHiN, (vi) dispute with the User.

In this case, the User will be notified by e-mail. Closure will then be effective within [seven] days of this notification being sent to the User.

If the User Account is inactive for a period of three years, it will be automatically closed.

• USING THE APPLICATION

• Conditions of use

The User undertakes to :

• use the Application in accordance with its intended purpose;
• use the Application in compliance with applicable laws and regulations;
• use the Application for personal purposes only, to the exclusion of any commercial use.

In general, the User uses the Application under his sole responsibility and at his own risk.

• Restrictions on use

The User also undertakes to :

• not to conceal his or her identity or use the identity of another person in order to create a User Account, access the Application and/or use it;
• not to hijack another User's Account;
• not to interfere with the operation of the Application;
• not to make commercial use of the Application or the data contained therein;
• not to use the Application or its technical infrastructure in an abusive, excessive or otherwise inappropriate or harmful manner;
• not to use the Application to promote, sell or advertise by any means products and/or services of any kind;
• not to engage in any conduct or encourage any conduct that would adversely affect or reflect negatively on WASHiN ;
• not to use automated systems linked to the Application, such as bots;
• not to extract data from the databases contained in the Application. The use of automated systems or software to extract data from the Application ("screen scraping ") or to index it (" crowling ") is strictly prohibited.

• APPLICATION AVAILABILITY

Use of the Application requires Internet access.

WASHiN undertakes to use its best efforts to ensure that the Application is available 24 hours a day, 7 days a week, regardless of maintenance operations. In this respect, WASHiN is only bound by an obligation of means.

WASHiN also reserves the right to suspend or terminate access to all or part of the Application or User Account for maintenance or security reasons, without prior notice and without this being liable to give rise to any compensation to the User.

WASHiN is under no obligation to provide updates to the Application to ensure compatibility with a specific terminal or terminal operating system.

1. INTELLECTUAL PROPERTY

The Application and all its components (including source code) or content (including text, animations, interactive features, photographs, images, logos, trademarks, etc.) are protected by intellectual property rights and are the exclusive property of WASHiN or third parties with whom WASHiN has entered into an operating license.

The User agrees not to infringe in any way whatsoever the intellectual property rights mentioned above, directly or indirectly.

Consequently, the User agrees to refrain from any type of use not explicitly provided for by law or not expressly authorized by these GCU, and in particular :

• to use the content of the Application outside the conditions set out herein, and in particular for commercial purposes;
• create, maintain or provide unauthorized connections to the Application;
• reproduce or copy, permanently or temporarily, the Application, in whole or in part, by any means and in any form;
• capture, disseminate, archive, publish, distribute, market, rent, license, transfer or otherwise make available to a third party, by any means whatsoever, including via the Internet, whether in return for payment or free of charge, all or part of the Application or its content;
• adapt, modify, transform or arrange the Application or its content, even partially, in particular with a view to creating derived works, software or derived or new functionalities of any kind whatsoever;
• reverse-engineer, derive, disassemble or decompile the Application, or translate it into other languages and, in general, reconstitute, reproduce or transpose its functionalities;
• alter, modify, move or replace the trademarks, trade names, logos, copyright and any distinctive element of WASHiN as they are or may have been affixed to the Application, its content and each of its component parts.

Subject to the application of a specific legal provision, any use of an element protected by an intellectual property right must be subject to prior written authorization from WASHiN.

WASHiN is also the sole owner of the intellectual property rights to the name, brand and logo used and incorporated into the Application. The "WASHIN" trademark is registered in France and abroad (registration numbers 4579513 and 1523166). The use of the name, brand or logo belonging to WASHiN therefore requires the prior written authorization of WASHiN.

1. PERSONAL DATA

When using the Application, WASHiN may collect and process Users' personal data.

This is notably the case when a User (i) creates a User Account, (ii) agrees to be geolocated, (iii) agrees to receive notifications, (iv) places an order, and (v) exchanges with WASHiN by post, email, or via the contact form available in the "Contact Us" section.

WASHiN undertakes to collect and process Users' personal data in accordance with the regulations in force, and in particular with the General Regulation on the Protection of Personal Data (RGPD) and Law no. 78-17 of January 6, 1978 relating to information technology, files and freedoms as amended (Loi Informatique et Libertés).

For more information on the conditions under which personal data is collected and processed, the User is invited to consult WASHiN's Privacy Policy.

1. RESPONSIBILITY

11.1 Responsibility of the User

11.1.1 Use of the Application

L’Utilisateur est seul responsable de l’utilisation qu’il fait de l’Application. En particulier, la responsabilité de WASHiN ne saurait être engagée en cas d’utilisation de l’Application non conforme aux présentes CGU ou à la réglementation en vigueur.

L’Utilisateur est également responsable de toute utilisation de son Compte Utilisateur, que celle-ci soit le fait de tiers autorisé ou non.

Pareillement, l’Utilisateur est seul responsable du choix des Programmes qu’il est susceptible de commander par l’intermédiaire de l’Application. Les informations contenues dans l’Application ne sauraient, en effet, être considérées comme valant recommandation ou prescription de commande.

       11.1.2 Utilisation des Machines

De manière générale, l’Utilisateur utilise les Machines sous sa seule responsabilité et à ses risques et périls. Il doit scrupuleusement sélectionner les Programmes adaptés au linge qu’il souhaite laver ou sécher et doit respecter les indications de lavage et de séchage portées sur les vêtements et sur le linge.

WASHiN ne saurait en aucune façon être responsable de dommages résultant d’un mauvais choix de programme, de température, d’un mélange de couleurs et, de manière générale, du non-respect des consignes d’utilisation et de sécurité par l’Utilisateur ou par un tiers.

       11.1.3 Commentaires, avis, informations, communiqués sur le réseau Internet

L’Utilisateur est responsable des commentaires, avis et de toute information, qu’il est susceptible de communiquer et de partager sur le réseau Internet relativement à l’Application et aux Machines, et notamment par le biais des plateformes de réseaux sociaux et de Google.

Les Utilisateurs qui auront volontairement tenus des propos ou communiqués des informations ayant un caractère inapproprié, incorrect ou dangereux, s’exposent à la suppression de leur Compte Utilisateur, sans préjudice des poursuites susceptibles d’être engagées.

       11.2 Responsabilité de WASHiN

11.2.1 Responsabilité liée à l’Application

WASHiN s’efforce d’assurer au mieux la mise à jour des informations diffusées sur l’Application. Toutefois, WASHiN ne peut garantir aux Utilisateurs que les informations mises à disposition des Utilisateurs sur l’Application sont exactes, à jour et exhaustives. Il est précisé que WASHiN n’est tenue, à ce titre, que d’une obligation de moyens.

En particulier, la responsabilité de WASHiN ne saurait être recherchée en cas de dysfonctionnement, d’une impossibilité d’accès ou de mauvaises conditions d’utilisation de l’Application qui ne lui sont pas directement imputables, notamment en cas d’utilisation d’un équipement non adapté, de perturbations imputables aux opérateurs réseaux, aux fournisseurs d’accès, à l’encombrement du réseau Internet.

11.2.2 Responsabilité liée à l’exécution des Programmes et à l’utilisation des Machines

Les Machines sont en libre-service, dans des laveries automatiques accessibles au public. WASHiN ne saurait être responsable des vols, des dégradations ni des dommages causé au linge ou aux biens des Utilisateurs qui auraient été déposés dans les laveries. Il est recommandé à l’Utilisateur d’être présent lors de la récupération de ses effets personnels à la fin de chaque Programme.

11.2.3. Généralités

La responsabilité de WASHiN ne peut pas être engagée en cas d’inexécution ou de mauvaise exécution d’une commande due, soit au fait de l’Utilisateur, soit au fait d’un tiers.

WASHiN ne pourra voir sa responsabilité engagée envers l’Utilisateur que pour des faits qui lui sont directement imputables et qui lui ont causé un préjudice direct.

La responsabilité de WASHiN ne pourra non pas plus être engagée pour tous les inconvénients ou dommages liés à l’utilisation du réseau de l’Internet, notamment une perte de données, une rupture de service, une intrusion extérieure ou la présence de virus informatiques.

La responsabilité de WASHiN est totalement exclue dans un cas d’événement qualifiable de force majeure au sens de l’article 1218 du Code civil, et recouvrant notamment les faits suivants : panne d’électricité, panne de réseau internet ou de téléphonie mobile et, de manière générale, tout événement inévitable et imprévisible et échappant au contrôle de WASHiN au sens qu’en donnent la loi et la jurisprudence.

• LOI APPLICABLE, RECLAMATION ET MEDIATION

Les CGU ainsi que tous différends liés à leur validité, leur interprétation, leur exécution ou leurs suites sont soumis au droit français et relèvent de la compétence exclusive de tribunaux français compétents.

Pour toute question ou réclamation, l’Utilisateur peut contacter le service clientèle de WASHiN aux coordonnées figurant à l’article 1 des présentes.

Par ailleurs, conformément aux dispositions du Code de la consommation, l’Utilisateur ayant le statut de consommateur, dispose du droit de recourir gratuitement à un médiateur de la consommation en vue de la résolution amiable d’un éventuel litige qui l’opposerait à WASHiN. L’Utilisateur pourra accéder aux noms, coordonnées et sites Internet des médiateurs référencés grâce au site internet www.mediation-conso.fr.

Enfin, l’Utilisateur est informé que la Commission Européenne a mis en place une plateforme de Règlement en Ligne des Litiges, facilitant le règlement indépendant par voie extrajudiciaire des litiges en ligne entre consommateurs et professionnels de l’Union européenne. Cette plateforme est accessible à l’adresse https://webgate.ec.europa.eu/odr/.
